On Joint Enterprise

The Guardian has also recently pointed to stats which also show joint enterprise seems to disproportionately criminalise young black and mixed-race men: www.theguardian.com/society/2015/sep/22/joint-enterprise-criminalise-young-people-reform-guilt-association. The Supreme Court is due to hear appeal in Jogee soon: www.supremecourt.uk/cases/uksc-2015-0015.html. I think this case concerns foresight in ordinary accessorial liability, but I also heard that Jogee may be joined with a Privy Council case concerning joint common purpose/joint enterprise. It will be interesting to see if the courts use this as an opportunity to restrict secondary liability.

I hadn't realised that the Jogee appeal was coming up for hearing next month - definitely something I'm going to keep a look out for. I like the idea of doing an ICRU event on this, and possibly getting campaign groups like the two intervenors (JENGbA and Just for Kids Law) involved as well.
